Civil Litigation in Virginia General District Court

One practical note on small cases: claims of $5,000 or less can be filed in the small claims division, where the parties are required to represent themselves and an attorney cannot appear for them. A defendant who has been sued there has the right to remove the case to the General District Court and to be represented by counsel (Virginia Code § 16.1-122.4).

What to Expect in General District Court

Virginia's General District Courts hear civil claims within their jurisdictional limits, on a faster timeline and with simpler procedure than Circuit Court. A typical case begins with a warrant in debt or other civil warrant, sets a return date, and moves to trial before a judge. Deadlines matter: responding late, or not at all, can mean judgment by default. If a case is decided against you, Virginia Code § 16.1-106 gives you only ten days to note an appeal to Circuit Court, where it is heard fresh. Noting the appeal is only the first step: under § 16.1-107 an appellant generally also has to pay the writ tax and costs, and post an appeal bond, within thirty days of the judgment, and within only ten days in an unlawful detainer case (§ 8.01-129), though there are exceptions, including for indigent defendants and, in some cases, defendants with liability insurance. Appeals are lost on these steps more often than on the merits, so it is worth getting advice quickly rather than at the end of the window. Whether you have been served with a warrant in debt or need to pursue someone who owes you money, early advice makes the process far more manageable.
